STF confirma licença-maternidade a partir da alta hospitalar da mãe ou do bebê

Por unanimidade, o Supremo Tribunal Federal (STF) confirmou que o marco inicial da licença-maternidade e do salário-maternidade é a alta hospitalar da mãe ou do recém-nascido – o que ocorrer por último. A medida se restringe aos casos mais graves, em que as internações excedam duas semanas.

A decisão foi tomada no julgamento de mérito da Ação Direta de Inconstitucionalidade (ADI) 6327, na sessão virtual finalizada em 21/10. A decisão torna definitiva a liminar concedida pelo relator, ministro Edson Fachin, referendada pelo Plenário em abril deste ano.

Na ação, o partido Solidariedade pedia que o STF interpretasse dois dispositivos: o parágrafo 1º do artigo 392 da Consolidação das Leis do Trabalho (CLT), segundo o qual o início do afastamento da gestante pode ocorrer entre o 28º dia antes do parto e a data do nascimento do bebê; e o artigo 71 da Lei 8.213/1991, que trata do dever da Previdência Social de pagar o salário-maternidade com base nos mesmos termos. Para o partido, a literalidade da legislação deve ser interpretada de forma mais harmoniosa com o objetivo constitucional, que é a proteção à maternidade, à infância e ao convívio familiar.

Proteção à infância

Ao votar pela procedência do pedido, ratificando a liminar, o relator afirmou que a interpretação restritiva das normas reduz o período de convivência fora do ambiente hospitalar entre mães e recém-nascidos. Essa situação, a seu ver, está em conflito com o direito social de proteção à maternidade e à infância e viola dispositivos constitucionais e tratados e convenções assinados pelo Brasil.

Omissão inconstitucional

Segundo o relator, é na ida para casa, após a alta, que os bebês efetivamente demandarão o cuidado e a atenção integral dos pais, especialmente da mãe. Ele explicou que há uma omissão inconstitucional sobre a matéria, uma vez que as crianças ou as mães internadas após o parto são privadas do período destinado à sua convivência inicial de forma desigual.

O ministro ressaltou que essa omissão legislativa resulta em proteção deficiente tanto às mães quanto às crianças prematuras, que, embora demandem mais atenção ao terem alta, têm esse período encurtado, porque o tempo de permanência no hospital é descontado do período da licença.

Outro ponto observado por Fachin é que a jurisprudência do Supremo tem considerado que a falta de previsão legal não impede o deferimento do pedido. Segundo ele, o fato de uma proposição sobre a matéria tramitar há mais de cinco anos no Congresso Nacional demonstra que a via legislativa não será um caminho rápido para proteção desses direitos.

Fonte de custeio

O relator também afastou o argumento de falta de fonte de custeio para a implementação da medida. “O benefício e sua fonte de custeio já existem”, afirmou. De acordo com o ministro, a Seguridade Social deve ser compreendida integralmente, como um sistema de proteção social que compreende um conjunto integrado de ações de iniciativa dos poderes públicos e da sociedade.
